remainders, rents issues and profits thereof and also all the estate right title interest use trust property possession claims and demand whatsoever of them the said party of the first part whether in all or equity or otherwise howsoever, of, is, to or out of the same. To Have and to hold the said piece or parcel of land with the hereditaments and premises hereby granted and released or mentioned or intended so to be with the appurtenances unto the said party of the second part his heirs and assigns, to the only proper use and benefit & behoof of the said party his heirs and assigns forever. And the said parties of the first part for themselves their heirs executors and administrators, do covenant promise grant and agree to and with said party of the second part his heirs and assigns by these presents, that he the said party of the second part and his heirs, the said hereby granted premises or tract of land with the hereditaments and premises hereby granted and released or mentioned or intended so to be with the appurtenances unto the said his heirs and assigns, against them the said parties of the first part and their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim of in or out of the said premises shall and will warrant and forever defend by these presents. State of Ohio Geauga County ss, [scilicet] July 3d 1833 Personally appeared before me a justice of the peace for said Joseph Smith jr and his wife to me personally known to be the signers and sealers of the foregoing instrument and acknowledged the same to be their free act and deed. Also the said acknowledged the same as done freely without force or compulsion Justice of the peace The State of Ohio, Geauga County ss. December 17 1834 Personally appeared Joseph Smith jr who acknowledged that he did sign and seal the foregoing instrument and that the same is his free act and deed. I further certify that I did examine the said separate and apart from her said husband and did then and there make known to her the contents of the foregoing instrument and upon that examination she declared that she did voluntarily sign, seal and acknowledge the same and that she was still satisfied therewith Before me Daniel Kerr Associate Judge of Pleas. I Clerk of the Court of Common Pleas for said do hereby certify that Daniel Kerr Esquire before whom the within Deed appears to have been acknowledged on the seventeenth day of December AD. 1834 was at that time and still is one of the associate Judges of the Court of Common Pleas for said , duly commissioned & sworn according to law: and further that I am well acquainted with the handwriting of the said Judge and do verily believe the above signature purporting to be his is true and genuine.
