miles that they have used all the diligence and exertion in their power to procure the testimony of said witnesses here at this term of the Court but have been unable to do so, that they have not had time to have the depositions of said witnesses taken since this special term of the Court was ordered that the Circuit attorney lives here in Columbia and that there was not time to give him the legal and necessary notice for the taking of Depositions, and that as a◊◊◊◊◊tant they had good reason to believe and did believe that they would attend personally.
